Security and protection of your personal data

We consider it our primary task to maintain the confidentiality of the personal data you provide and to protect it from unauthorized access. We therefore take the utmost care and apply the latest security standards to ensure maximum protection of your personal data.

As a company under private law, we are subject to the provisions of the European General Data Protection Regulation (GDPR) and the provisions of the German Federal Data Protection Act (BDSG). We have taken technical and organizational measures to ensure that the data protection regulations are observed both by us and by our external service providers.

Information on the collection of personal data

(1) In the following, we provide information about the collection of personal data when using our website. Personal data are e.g. name, address, e-mail addresses, user behavior.

(2) If you contact us by e-mail or via a contact form, the data you provide (your e-mail address, your name and telephone number if applicable) will be stored by us in order to answer your questions. We delete the data collected in this context after storage is no longer necessary, or processing is restricted if there are statutory retention obligations.

Collection of personal data when visiting our website

When using the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. Right to information

If personal data is processed, you can request information about this personal data and the following information at any time

  • the purposes of processing;
  • the categories of personal data being processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
  • the existence of a right to rectification or erasure of personal data concerning you or to restriction of processing by the controller or a right to object to such processing
  • the existence of a right to lodge a complaint with a supervisory authority
  • where the personal data are not collected from the data subject, any available information as to their source
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

Where personal data are transferred to a third country or to an international organization, you have the right to be informed of the appropriate safeguards pursuant to Article 46 GDPR relating to the transfer. We will provide a copy of the personal data that is the subject of the processing. For any further copies you request, we may charge a reasonable fee based on administrative costs. If you make the request electronically, the information must be provided in a commonly used electronic format. The right to receive a copy in accordance with paragraph 3 must not adversely affect the rights and freedoms of others.


Right to rectification

You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement.


Right to erasure ("right to be forgotten")

You have the right to obtain from the controller the erasure of personal data concerning you without undue delay and we are obliged to erase personal data without undue delay where one of the following grounds applies:

  • The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
  • The data subject withdraws consent on which the processing is based according to point (a) of Article 6(1), or point (a) of Article 9(2) GDPR, and where there is no other legal ground for the processing.
  • The data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR.
  • The personal data have been processed unlawfully.
  • The personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.
  • The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) GDPR.

Where the controller has made the personal data public and is obliged pursuant to paragraph 1 to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

The right to erasure ("right to be forgotten") does not exist insofar as the processing is necessary

  • For exercising the right of freedom of expression and information;
  • for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
  • for reasons of public interest in the area of public health in accordance with Article 9(2)(h) and (i) and Article 9(3) GDPR
  • for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1) GDPR in so far as the right referred to in paragraph 1 is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
  • for the establishment, exercise or defense of legal claims.


Right to restriction of processing

You have the right to demand that we restrict the processing of your personal data if one of the following conditions is met

  • the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data,
  • the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead
  • the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims; or
  • the data subject has objected to processing pursuant to Article 21(1) GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.

Where processing has been restricted in accordance with the above conditions, such personal data shall, with the exception of storage, only be processed with the data subject's consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

Right to data portability

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where

  • the processing is based on consent pursuant to Article 6(1)(a) or Article 9(2)(a) or on a contract pursuant to Article 6(1)(b) GDPR, and
  • the processing is carried out by automated means.

In exercising the right to data portability pursuant to paragraph 1, you have the right to have the personal data transmitted directly from one controller to another, where technically feasible. The exercise of the right to data portability does not affect the right to erasure ("right to be forgotten"). This right does not apply to processing that is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.


Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.

Where personal data are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. If you object to processing for direct marketing purposes, the personal data will no longer be processed for these purposes.

In the context of the use of information society services, and notwithstanding Directive 2002/58/EC, you may exercise your right to object by automated means using technical specifications.

You have the right to object, on grounds relating to your particular situation, to processing of personal data concerning you which is carried out for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

You can exercise your right to object at any time by contacting the respective controller.


Automated decisions in individual cases, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision

  • is necessary for the conclusion or performance of a contract between the data subject and the controller
  • is authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or
  • with the express consent of the data subject.

The data controller shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

The data subject can exercise this right at any time by contacting the respective controller.


Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you also have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes this Regulation.


Right to an effective judicial remedy

Without prejudice to any available administrative or extrajudicial remedy, including the right to lodge a complaint with a supervisory authority pursuant to Article 77 GDPR, you have the right to an effective judicial remedy if you consider that your rights under this Regulation have been infringed as a result of the processing of your personal data in non-compliance with this Regulation.

Use of Google Maps

We use Google Maps on this website, which is provided by Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. This allows us to show you interactive maps directly on the website and enables you to use the map function conveniently.

When you visit the website, Google receives the information that you have accessed the corresponding subpage of our website. The data listed below is also transmitted. This occurs regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish your data to be associated with your Google profile, you must log out before activating the button. Plugins from the Vimeo video portal of Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA are embedded on our website. When you start playing a Vimeo video clip, a direct connection is established between your browser and a Vimeo server in the USA. Information about your visit and your IP address will be stored there. By interacting with the Vimeo plugins (e.g. clicking the start button), this information is also transmitted to Vimeo and stored there.

If you have a Vimeo user account and do not want Vimeo to collect data about you via this website and link it to your membership data stored with Vimeo, you must log out of Vimeo before visiting this website. Perspective Funnel

General information

This website uses Mobile Funnel (hereinafter: Funnel), operated by Perspective Software GmbH (hereinafter: Perspective), a company based in Germany, which offers software for the creation and operation of Mobile Funnel(https://perspective.co/impressum). The data entered when using Mobile Funnels is transmitted using SSL encryption and stored in a database. The operator of this website is solely responsible for this data within the meaning of Art. 24 GDPR. Perspective is merely the operator of the software and, in this context, a processor in accordance with Art. 28 GDPR. The basis for the processing by Perspective is an order processing contract between the controller and Perspective. In addition, Perspective Software GmbH processes further data, some of which may also be personal data, in order to provide its services, in particular for the operation of the Mobile Funnel. This is described in more detail below.

Access logs ("server logs")

Every time the Funnel is accessed, general log data, so-called server logs, are automatically recorded. These data are generally pseudonyms and therefore do not allow any conclusions to be drawn about a natural person. Without this data, it would not be technically possible in some cases to deliver and display the content of the software. In addition, the processing of this data is absolutely necessary for security reasons, in particular for access, input, transmission and storage control. In addition, the anonymous information can be used for statistical purposes and to optimize the offering and technology. In addition, the log files can be subsequently checked and analyzed in the event of suspected illegal use of the software. The legal basis for this can be found in Section 15 (1) of the German Telemedia Act (TMG) and Art. 6 (1) f GDPR. Data such as the domain name of the website, the web browser and web browser version, the operating system and the timestamp of access to the software are generally recorded. The user's IP address is not stored. However, the user is assigned a so-called session ID. The scope of this logging does not exceed the usual scope of any other website on the Internet. The storage period of these access logs is up to 7 days. There is no right of objection.


Collection of user behavior data

In general, data such as the domain name of the website, the web browser and web browser version, the operating system, the user's session ID and the timestamp of access to the software are recorded. All data that the user enters when using the Funnel (e.g. answering form fields; use of interactive components) is assigned to the user by means of a session ID and made available to the operator of this website. The operator of this website is responsible for the deletion, storage and further processing of this personal data in accordance with current legislation.

Rights of data subjects

Final provisions

Perspective reserves the right to adapt this data protection declaration at any time so that it always complies with the current legal requirements or to implement changes to the services in the data protection declaration, e.g. when introducing new services. The new privacy policy will then apply when you visit the Funnel again.

 

Facebook Pixel

This website uses Facebook's visitor action pixel to measure conversions. The provider of this service is Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Facebook, the data collected is also transferred to the USA and other third countries.

This allows the behavior of site visitors to be tracked after they have been redirected to the provider's website by clicking on a Facebook ad. This allows the effectiveness of Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimized.

The data collected is anonymous to us as the operator of this website; we cannot draw any conclusions about the identity of the users.
